On May 14, 2004, an Application for Review was filed on behalf of the City of Mentor, Ohio (the “City”) requesting that the Commission reverse the decision of the Media Bureau, MB- ILR 04- 1 (rel. April 15, 2004) in the above- captioned case. The Letter Ruling concluded that Comcast Cable Communications, Inc. (“ Comcast”) operator of a cable television system in Mentor, did not violate Section 624 (d) (3) of the Communications Act, 47 U. S. C. § 544( d) (3). 2. On March 7, 2006, the City filed a Motion to Withdraw Application for Review. In its Motion, the City states that Comcast and the City have resolved this matter and the dispute is now moot. The City requests that the Application for Review and related pleadings be dismissed without benefit of substantive Commission review. 3. Accordingly, the Motion to Withdraw Application for Review filed by the City of Mentor, Ohio IS GRANTED and the Application for Review IS DISMISSED. 4.
