The Audio Division has before it a Notice of Proposed Rule Making 1 issued at the request of Jeraldine Anderson d/ b/ a Carrizo Springs Broadcasting (“ Petitioner”), proposing the allotment of Channel 295A at Carrizo Springs, Texas, as the community’s third local service. Petitioner filed comments in support of the proposal and reiterated her intention to file an application for the channel and to construct the facilities if the application is granted. Linda Crawford filed a counterproposal. 2 No other comments were filed. 2. We will grant the petition. Carrizo Springs is an incorporated community of 5,655 persons with its own mayor, schools, fire department post office and numerous churches. Accordingly, Carrizo Springs is a community deserving of a third local and second competing commercial FM service. 3 Petitioner states that Channel 295A will provide additional diversity and an outlet for local self-expression to the residents of Carrizo Springs and therefore is in the public interest. 3. Channel 295A is allotted at Carrizo Springs with a site restriction of 8.1 kilometers (5.1 miles) south of the community. 4 4. The Commission will send a copy of this Report and Order in a report to be sent to Congress and the Government Accountability Office pursuant to the Congressional Review Act. 5 5. Accordingly, pursuant to the authority found in Sections 4( i), 5( c)( 1), 303( g) and (r) and 307( b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204( b) and 0.283 of the Commission’s rules, IT IS ORDERED, That effective, December 4, 2006, the FM Table of Allotments, 1 See Carrizo Springs, Texas, Notice of Proposed Rule Making, 21 FCC Rcd 2233 (MB 2006). 2 The Crawford counterproposal is defective and was not placed on public notice. It proposed to allot Channel 228C3 at Batesville, Texas, as the community’s first local service. This proposal required several channel substitutions. One, the substitution of Channel 295A for Channel 228A at Carrizo Springs, Texas, and the modification of the construction permit for Hispanic Target Media, Inc., is short spaced to an application for construction permit, File No. BSFH- 20050812ATA for Channel 295C2 at Rocksprings, Texas, which must be protected. 3 There is one FM station, Station KCZO( FM), Channel 221C3, and an application for Channel 228A at Carrizo Springs. 4 The coordinates for Channel 295A at Carrizo Springs are 28- 27- 00 NL and 99- 50- 30 WL. 5 See 5 U. The window period for filing applications for Channel 295A at Carrizo Springs will not be opened at this time. Instead, the issue of opening this allotment for auction will be addressed by the Commission in a subsequent order. 7. IT IS FURTHER ORDERED, That the counterproposal filed by Linda Crawford IS DISMISSED. 8. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED. 9.
