On October 6, 2006, UltraVision Security Systems, Inc. (“ UltraVision”) filed a request for a waiver of Part 15 of the Commission’s rules to permit the marketing and operation of an ultra- wideband (“ UWB”) surveillance system that operates below 700 MHz. The UltraVision Surveillance system does not operate within the 1990- 10600 MHz band as required under Section 15.511( a), although it otherwise complies with the emission limits of that rule. UltraVision also requests that the categories of parties eligible to operate UWB surveillance systems, as specified in Section 15.511( b), be expanded to permit operation by any entity eligible for licensing under the Part 90 regulations. 2. On October 24, 2006, the Commission issued a Public Notice on UltraVision’s Request for Interpretation and Waiver in the above- captioned docket. Comments are presently due on November 24, 2006 and reply comments on December 8, 2006. 3. On November 16, 2006, UltraVision requested a 90- day extension of the comment and reply comment periods until February 22, 2007 and March 8, 2007, respectively. UltraVision indicated that it has been in talks with interested parties and those talks resulted in an agreement that further technical studies will be carried out. UltraVision stated that the extension of time is necessary due to the intervening holidays and in order to provide the Commission with the benefits of the results from the technical studies, which it believes will improve the basis for an ultimate Commission’s decision in the matter, while not prejudicing any party. 4. We find that an extension of the comment and reply comment periods will enable the concerned parties to conduct technical studies and fully analyze the results, and, thus, provide a more complete record for Commission consideration. Accordingly, IT IS ORDERED, pursuant to the delegated authority contained in 47 C. F. R. §§ 0.31 and 0.241( a), that the time period for filing comments in the above- captioned proceeding IS EXTENDED to February 22, 2007, and the time period for filing reply comments in the above- captioned proceeding IS EXTENDED to March 8, 2007.
