C. 20554 News Media Information 202 / 418- 0500 Internet: http:// www. fcc. gov TTY: 1- 888- 835- 5322 DA 06- 2536 Released: December 18, 2006 WIRELESS TELECOMMUNICATIONS BUREAU GRANTS ADVANCED WIRELESS SERVICE LICENSES AUCTION EVENT NO. 66 On September 18, 2006, the Wireless Telecommunications Bureau (“ Bureau”) completed an auction of Advanced Wireless Service (“ AWS”) licenses (“ Auction No. 66”), in which the winning bidders won a total of 1,087 licenses. 1 In two separate notices, the Bureau announced that, based upon a preliminary review of the long- form applications, it was accepting for filing the applications for the winning bidders in Auction No. 66. 2 Upon further review and examination, the applications listed in Attachment A have been found to be complete and in conformance with the Commission’s rules. 3 Furthermore, the Commission has received full and timely payment as required by section 1.2109( a) of 1 See Auction of Advanced Wireless Services Closes: Winning Bidders Announced for Auction 66, Report No. AUC- 06- 66- F, Public Notice, DA 06- 1882 (WTB rel. Pursuant to these two notices, all of the winning bidders’ applications have been accepted for filing. Nov. 29, 2006). 3 AST Telecom, LLC (" AST") filed a petition requesting that the Commission find permissible the indirect foreign ownership of AST in excess of the 25 percent benchmark set forth in Section 310( b)( 4) of the Communications Act of 1934, as amended, 47 U. S. C. § 310( b)( 4). The International Bureau has found that the public interest would be served by granting this request. See ISP- PDR- 20061004- 00014 (granted Dec. 15, 2006). We also note that, in its application, PetroCom License Corporation (“ PetroCom”) reports the filing of applications seeking consent to transfer of control of its wireless authorizations (ULS File No. 0002734993). PetroCom states that, “[ I] n the unlikely event that the FCC approves the requested consent to transfer of control, and the parties proceed to consummate the proposed transaction, the parties to the applications for transfer of control have requested that the FCC waive its rules, to the extent necessary, to permit the amendment of any pending applications for new licenses, to reflect the new ownership, to be characterized as minor amendments.” PetroCom Ex. Since the transfer applications have not yet been granted, applicant’s request is moot, and PetroCom’s AWS- 1 license application has been reviewed on the basis of its current ownership only. 1 2 the Commission’s rules, for the licenses listed in Attachment A, 4 and there are no petitions to deny or other requests pending that would prevent grant of the licenses. Accordingly, by this Public Notice, we announce the grant of the licenses listed in Attachment A. We grant these licenses pursuant to Section 309( a) of the Communications Act, 47 U. S. C. § 309( a), and section 0.331 of the Commission’s rules, 47 C. F. R. § 0.331, because it will serve the public interest, convenience, and necessity.
