PETITION FOR DECLARATORY RULING AND ORDER OF PREEMPTION CC Docket No. 96- 128 COMMENTS: February 28, 2006 REPLY COMMENTS: March 10, 2006 On January 31, 2006, the Florida Public Telecommunications Association, Inc. (FPTA) filed a petition for declaratory ruling asking the Commission to: declare that, from April 15, 1997 to November 10, 2003, BellSouth Telecommunications, Inc. (BellSouth) collected end user common line charges (aka subscriber line charges) in addition to unadjusted local payphone access line charges in contravention of section 276 of the Communications Act; declare that BellSouth must refund to the relevant payphone service providers the charges those providers paid to BellSouth from April 15, 1997 to November 10, 2003 with interest, to the extent those charges exceeded rates that comply with section 276 of the Act, including the equivalent of any end user common line charge amounts collected during that period of time and; preempt a Florida Public Service Commission ruling that FPTA alleges is inconsistent with the Commission’s regulations. We invite comments on the FPTA petition. Interested parties may file comments on or before February 28, 2006 and reply comments on or before March 10, 2006. Comments may be filed using the Commission’s Electronic Comment Filing System (ECFS) or by filing paper copies. 1 Comments filed through the ECFS can be sent as an electronic file via the Internet to http:// www. fcc. gov/ cgb/ ecfs/. Generally, only one copy of an electronic submission must be filed.
