On April 15, 2005, Comcast Cable of Dallas, Inc. (“ Comcast”), filed with the Commission a petition seeking partial reconsideration of the order adopted in Comcast Cable of Dallas, (“ Order”), which was released by the Media Bureau on March 16, 2005. 1 The Order granted in part and denied in part Comcast’s appeal of a rate order adopted by the City of Dallas, Texas (“ City”) on June 23, 2004. 2. On January 23, 2006, Comcast filed a Motion to Withdraw Petition for Reconsideration. Comcast states that since the Commission has ruled affirmatively on a related effective competition petition finding that Comcast faced effective competition in Dallas, 2 there is no longer any need to burden the Commission with a review of the Order. Comcast requests that its Petition for Reconsideration be dismissed without benefit of substantive Commission review. 3. Accordingly, IT IS ORDERED that the Motion to Withdraw Petition for Reconsideration filed by Comcast Cable of Dallas, L. P. IS GRANTED and the Petition for Partial Reconsideration filed by Comcast of Dallas, L. P. on April 15, 2005 IS DISMISSED. 4.
