C. 20554 In the Matter of Amendment of Section 73.202( b), FM Table of Allotments, FM Broadcast Stations. (Stringtown and Haileysville, Oklahoma) ) ) ) ) ) ) MM Docket No. 05- 110 RM- 11193 REPORT AND ORDER (Proceeding Terminated) Adopted: February 22, 2006 Released: February 24, 2006 By the Assistant Chief, Audio Division, Media Bureau: 1. The Audio Division has before it the “Request for Approval of Withdrawal,” submitted on behalf of Charles Crawford (“ Crawford”), seeking to dismiss his petition for rule making pending in this proceeding. 1 Previously, Crawford had filed a petition for rulemaking seeking the allotment of Channel 290A at Stringtown, Oklahoma. In order to accommodate that allotment, in his petition, Crawford also proposed the substitution of Channel 252A for vacant Channel 290A at Haileysville, Oklahoma. A notice of proposed rulemaking was issued, proposing the allotment changes requested by Crawford. 2 2. Crawford now states that he is no longer interested in the allotment of Channel 290A at Stringtown, Oklahoma, and he seeks approval of his withdrawal of interest. Crawford further states that no consideration has been paid or promised, directly or indirectly, for such withdrawal. 3 3. It is the Commission’s policy to refrain from making an allotment to a community absent an adequate expression of interest. By filing his “Request for Approval of Withdrawal,” Crawford has demonstrated that he has no continuing interest in the requested allotment. 4. Accordingly, IT IS ORDERED, That the petition for rule making filed by Charles Crawford, proposing the allotment of Channel 290A at Stringtown, Oklahoma, and the substitution of Channel 252A for vacant Channel 290A at Haileysville, Oklahoma, IS DISMISSED. 1 Crawford originally filed a request to withdraw his petition on August 23, 2005, followed by a pleading on September 19, 2005, requesting the reinstatement of his expression of interest. Most recently, on October 26, 2005, Crawford submitted a “Request for Approval of Withdrawal,” which he describes as a “final withdrawal of interest.” 2 Amendment of Section 73.202( b), Table of Allotments, FM Broadcast Stations, Mojave and Trona, California, Stringtown and Haileyville, Oklahoma, and Cumberland Head, New York, 20 FCC Rcd 5999 (MB 2005). 3 See 47 C.
