 NOTICE  OF  PROHIBITED  PRESENTATION  IN  THE  MATTER  OF  ANNUAL  ASSESSMENT  OF  THE  STATUS  OF  COMPETITION  IN  THE  MARKET  FOR  THE 
 DELIVERY  OF  VIDEO  PROGRAMMING  (MB  DOCKET  NO.  05-  255) 
 Notice  is  hereby  given  that  a  prohibited  written  presentation  by  Qwest  Communications  International  Inc.  concerning  the  above-  referenced  proceeding  (MB  Docket  No.  05-  255)  has 
 been  received  by  the  Commission  on  March  2,  2006.  Section  1.1203  of  the  Commission's  Rules,  47  C.  F.  R.  §  1.1203,  prohibits  the  making  of  any  presentation,  with  specified  exceptions  not 
 applicable  here,  whether  ex  parte  or  not,  to  decision-  making  personnel  concerning  any  matter  listed  on  the  Commission's  Sunshine  Agenda  until  the  Commission  releases  the  text  of  a  decision 
 or  order  relating  to  that  matter  or  removes  the  item  from  the  sunshine  agenda.  The  instant  presentation  addressed  the  merits  of  MB  Docket  No.  05-  255,  which  was  included  in  the 
 Commission's  Sunshine  Agenda  by  Public  Notice  released  February  3,  2006.  Accordingly,  under  Section  1.1212  of  the  Commission's  Rules,  47  C.  F.  R  §  1.1212,  this  presentation,  and  any 
 similar  presentations  also  received  during  the  Sunshine  Agenda  period,  shall  be  associated  with,  but  not  made  a  part  of,  the  record  in  MB  Docket  No.  05-  255.
