On December 15, 2004, Adelphia Communications Corporation, on behalf of its affiliates and subsidiaries (“ Adelphia”), filed with the Commission an appeal of a local rate order adopted by the City of Cleveland Heights, Ohio (“ City”) on November 15, 2004. 2. In a Motion to Withdraw Appeal of Local Rate Order filed on December 12, 2005, Adelphia states that the underlying matter has been resolved with the City, and the dispute is now moot. Adelphia requests that the appeal be dismissed without benefit of substantive Commission review. 3. Accordingly, IT IS ORDERED that the Motion to Withdraw Appeal of Local Rate Order filed by Adelphia Communications Corporation IS GRANTED and the appeal filed on December 15, 2004 IS DISMISSED. 4.
