Federal Communications Commission DA 07-1053 Before the Federal Communications Commission Washington, D.C. 20554 In the Matter of Toll-Free Service Access Codes ) ) ) ) CC Docket No. 95-155 ORDER Adopted: March 6, 2007 Released: March 6, 2007 By the Acting Chief, Competition Policy Division: 1. In this Order, we dismiss as moot the petition for declaratory ruling filed by Ameritech Corporation, AT&T Corp., Bell Atlantic Corporation, Cincinnati Bell Inc., and SBC Communications Inc. (collectively, Petitioners) filed on September 22, 1998.1 Petitioners sought a declaratory ruling establishing that, to the extent that federal trademark registrations would give Jeman Holdings, Inc. (Jeman) and Toll-Free Cellular, Inc. (Toll-Free) exclusive rights to various “#8NN” and “*8NN” numbers, such registrations would violate the Commission’s policies on the fair and orderly allocation of toll-free numbers and would impact detrimentally the Commission’s efforts to further the development of wireless services.2 The U.S. Patent and Trademark Office never granted the Jeman and Toll-Free trademark registration requests and the applications show a status of “abandoned.”3 Therefore, the issue raised in the above-referenced petition for declaratory ruling is moot. 2. ACCORDINGLY, IT IS ORDERED, pursuant to sections 4(i) and 251(e) of the Communications Act of 1934, as amended, 47 U.S.C. §§ 154(i) and 251(e), and sections 0.91 and 0.291 of the Commission’s rules, 47 C.F.R. §§ 0.91, 0.291, that the petition for declaratory ruling filed by Ameritech Corporation, AT&T Corp., Bell Atlantic Corporation, Cincinnati Bell Inc., and SBC Communications, Inc. filed on September 22, 1998 IS DISMISSED.
