Washington, D.C. 20554 News Media Information 202 / 418-0500 Internet: http://www.fcc.gov TTY: 1-888-835-5322 DA 07-1074 March 7, 2007 Petition for Rulemaking to Eliminate Rate-of-Return Regulation of Incumbent Local Exchange Carriers CC Docket No. 96-45, RM-10822 NOTICE OF PROCEEDING TERMINATION On October 30, 2003, Western Wireless Corporation (Western Wireless) filed a petition for rulemaking to eliminate rate-of-return regulation for rural incumbent local exchange carriers for purposes of determining their federal high-cost universal services support and interstate access charges.1 On March 6, 2007, Alltel Corp. withdrew the Western Wireless petition for rulemaking in CC Docket No. 96-45, asked that RM-10822 be closed, and requested that the petition and the comments and reply comments on the petition be incorporated by reference into the record of the intercarrier compensation reform (CC Docket No. 01-92) and universal service (WC Docket No. 05-337) proceedings.2 This proceeding in CC Docket No. 96-45 and the rulemaking in RM-10822 are therefore terminated effective upon release of this Public Notice and the records are incorporated by reference into CC Docket No. 01-92 and WC Docket No. 05-337.
