On December 23, 1998, the Metropolitan Policy Commission ("MPC") filed an "evasion complaint" with the Commission alleging that TCI Cablevision of Oregon ("TCI"), the cable operator in Eugene (OR0132), Springfield (OR0135) and Lane County (OR0171) Oregon, had evaded the Commission’s rate regulations when calculating its cable programming services tier ("CPST") rates. TCI filed a Motion to Dismiss because the complaint was untimely and procedurally flawed. At the time, complaints against CPST rates were required to be filed on FCC Form 329. Because the complaint was not properly filed with the Commission, we grant the Motion to Dismiss. 2. Accordingly, IT IS ORDERED that the complaint filed by the Metropolitan Policy Commission IS DISMISSED. 3.
