Time Warner Cable (“Time Warner”) filed with the Commission on March 7, 2005 and October 14, 2005 two separate appeals of local rate orders adopted by the City of Wilson, North Carolina “City”) on February 17, 2005 and September 15, 2005.1 2. On December 15, 2006 Time Warner filed a Motion to Withdraw Local Rate Order Appeals. In its motion Time Warner states that the underlying dispute with the City has been resolved. Time Warner now requests that the appeals be withdrawn and dismissed. 3. Accordingly, IT IS ORDERED that the Motion to Withdraw Local Rate Order Appeals filed by Time Warner Cable IS GRANTED and the appeals filed on March 7, 2005 and October 14, 2005 ARE DISMISSED. 4.
