Federal Communications Commission DA 07-2425 Before the Federal Communications Commission Washington, D.C. 20554 In the Matter of Amendment of Part 101 of the Commission’s Rules to Modify Antenna Requirements for the 10.7 – 11.7 GHz Band ) ) ) ) ) ) ) WT Docket No. 07-54 RM-11043 ORDER Adopted: June 8, 2007 Released: June 8, 2007 By the Deputy Chief, Broadband Division, Wireless Telecommunications Bureau: 1. On March 27, 2007, the Commission released a Notice of Proposed Rulemaking in the above- captioned proceedings.1 Initial comments were due May 25, 2007, and reply comments are due on or before June 11, 2007.2 2. On June 6, 2007, Mobile Satellite Ventures Subsidiary LLC (MSV) filed a motion for extension of time to extend the date for filing reply comments to July 2, 2007.3 MSV states that it “hopes to use the additional time to have discussions with the parties to attempt to find a compromise.”4 MSV states that the majority of the commenters do not object to its request.5 No party has opposed the request. 3. It is the policy of the Commission that extensions of time are not routinely granted.6 Such extensions may be warranted when, among other reasons, the additional time will serve the public interest. In the present instance, we grant in part MSV’s motion for extension of time by extending the deadline to file reply comments to June 21, 2007. We find that providing a limited extension would serve the public interest by allowing the parties to have discussions to resolve their differences. We do not believe that granting the full extension requested is in the public interest, however. We note that parties have argued that prompt action is required in this proceeding.7 Furthermore, the parties can continue discussions to resolve their differences after reply comments are filed. On balance, we conclude that a ten-day extension 1 Amendment of Part 101 of the Commission’s Rules to Modify Antenna Requirements for the 10.7 – 11.7 GHz Band, WT Docket No. 07-54, Notice of Proposed Rulemaking, 22 FCC Rcd 6057 (2007). 2 Amendment of Part 101 of the Commission’s Rules to Modify Antenna Requirements for the 10.7 – 11.7 GHz Band, 72 Fed.
