Washington, D.C. 20554 News Media Information 202 / 418-0500 Internet: http://www.fcc.gov TTY: 1-888-835-5322 DA 07-2584 Released: June 13, 2007 EXTENSION OF TIME TO FILE COMMENTS ON THE USE OF EXCLUSIVE CONTRACTS FOR THE PROVISION OF VIDEO SERVICES TO MULTIPLE DWELLING UNITS MM Docket No. 07-51 Revised date for filing Comments: July 2, 2007 Revised date for filing Reply Comments: August 1, 2007 On March 27, 2007, the Commission released a Notice of Proposed Rulemaking seeking comment on the use of exclusive contracts for the provision of video services to multiple dwelling units or other real estate developments.1 Comments in response to the NPRM were originally due to be filed June 18, 2007, and reply comments were originally due to be filed July 18, 2007. On June 8, 2007, the Real Access Alliance (“RAA”), by its counsel, filed a motion for extension of time to file comments in response to the NPRM.2 RAA states that to provide useful answers to the questions raised by the Commission it would like to analyze the Commission’s recent Inside Wiring Order, an item which was recently adopted, but had not been released at the time that RAA filed its extension request.3 RAA argues that the subject matter of the Order bears on the issues raised in the pending NPRM, and that the Commission would benefit by a more complete record in the comments to the pending NPRM, if parties are able to evaluate the text of the Inside Wiring Order. According to RAA, extending the comment and reply comment due dates by two weeks would give RAA and others the opportunity to analyze the Order. As set forth in Section 1.46 of the Commission’s rules,4 it is the Commission’s policy that extensions of time for filing comments in rulemaking proceedings shall not be routinely granted. However, in view of the circumstances outlined by RAA as well as the short duration of the requested extension, we believe that a short extension of the comment and reply comment periods in this proceeding is warranted to facilitate the development of a complete record. Accordingly, were hereby grant RAA’s Motion for Extension of Time in this proceeding to the extent outlined herein. The time for filing comments is extended to July 2, 2007 and the time for filing reply comments is extended to August 1, 2007.
