On January 8, 2007, Mediacom Communications Corporation (“Mediacom”) filed an Application for Review, pursuant to Section 1.115 of the Commission’s rules,1 of the Media Bureau’s Memorandum Opinion and Order in the above-captioned proceeding.2 The Bureau’s Order denied Mediacom’s Complaint that Sinclair Broadcast Group, Inc. (“Sinclair”) violated its duty to negotiate retransmission consent in good faith for carriage of certain Sinclair owned and/or operated local broadcast television stations. On January 18, 2007, Mediacom filed an Emergency Petition for Reconsideration of another Media Bureau Order that denied Mediacom’s request for interim carriage.3 On October 31, 2006, Mediacom also filed, in conjunction with this proceeding, a Petition for Declaratory Ruling. 2. On February 2, 2007, Mediacom and Sinclair announced the completion of a retransmission consent agreement. On February 5, 2007, Mediacom filed with the Commission a “Motion to Withdraw and to Dismiss with Prejudice Application for Review, Emergency Petition for Reconsideration, and Petition for Declaratory Ruling.” Therein, Mediacom requests, with Sinclair’s consent, to withdraw and to dismiss with prejudice its Application for Review and Emergency Petition for Reconsideration and to withdraw its Petition for Declaratory Ruling. Accordingly, Mediacom Communications Corporation’s Motion to Withdraw and to Dismiss with Prejudice Application for Review, Emergency Petition for Reconsideration, and Petition for Declaratory Ruling IS GRANTED and the Application for Review and Emergency Petition for Reconsideration ARE DISMISSED WITH PREJUDICE and the motion to withdraw the Petition for Declaratory Ruling IS GRANTED. 4.
