On November 15, 2006, a program access complaint was filed on behalf of EchoStar Satellite L.L.C. (“EchoStar”) against Home Box Office, Inc. (“HBO”). On February 2, 2007, EchoStar filed a “Motion to Dismiss with Prejudice.” EchoStar states that it entered into a Program Service Agreement on January 30, 2007 with HBO for carriage by EchoStar of the HBO and Cinemax services.1 In light of this agreement, EchoStar will not further pursue its program access complaint against HBO. EchoStar states that HBO has consented to the Motion. In view of the foregoing, we grant EchoStar’s request. 2. Accordingly, EchoStar Satellite L.L.C.’s Motion to Dismiss with Prejudice its program access complaint against Home Box Office, Inc. IS GRANTED and EchoStar’s program access complaint IS DISMISSED WITH PREJUDICE. 3.
