The Audio Division has before it a Petition for Rule Making filed by Bruce Quinn (“Petitioner”), requesting the allotment of Channel 231A at Oolitic, Indiana, as the community’s first local transmission service.1 Petitioner states that he will file an application for Channel 231A at Oolitic to construct the facilities if the application is granted. 2. In support of the proposal, Petitioner states that Oolitic has a population of 1,200 persons, is 70 miles from major cities such as Indianapolis and Louisville, and deserves its first local service. The community was incorporated in 1901, is governed by a Town Council, has its own police and fire departments, and provides wastewater service and utilities to its citizens. It was founded for the trade of the oolitic limestone quarried nearby, which was used to build many great structures in New York City and Washington, D.C., including the Empire State Building and Washington National Cathedral. 3. We find that the allotment of Channel 231A could serve the public interest. A staff engineering review reveals that Channel 231A can be allotted in compliance with the Commission’s minimum distance separation requirements, with the imposition of a site restriction of 13.2 kilometers (8.2 miles) northwest of the community at reference coordinates 38-59-16 NL and 86-37-47 WL. We note that the proposed Channel 231A is short-spaced to the licensed site of Station WQKC-FM, Channel 229B, Seymour, Indiana. However, Station WQKC-FM’s license was modified to specify operation on Channel 230A at Sellersburg, Indiana in MB Docket No. 03-98.2 Moreover, the FM Table of Allotments was amended to reflect this change. Therefore, no protection is afforded to this license site. As such, we are sending a copy of this Notice of Proposed Rule Making to S.C.I. Broadcasting, Inc., licensee of Station WQKC-FM. 4. Accordingly, we seek comment on the proposed amendment of the FM Table of Allotments, Section 73.202(b) of the Commission’s Rules, with respect to the community listed below, to read as follows: 1 This Notice is being issued in response to a Petition for Reconsideration of the letter dismissal of a Petition for Rulemaking which was originally filed, and returned by letter.
