The Motion relates to an Application for Review (Application), filed by Wireless Network Properties, LLC (WNP) on June 21, 2007, which seeks review of an Order, released by the Spectrum and Competition Policy Division (Division) of the Wireless Telecommunications Bureau, denying WNP’s Petition for Declaratory Ruling regarding a proposed tower in Chattanooga, Tennessee.1 NPS, pursuant to Section 1.46 of the Commission’s Rules,2 requests an extension of time until July 20, 2007, to file its Opposition to WNP’s Application for Review. In its Motion, NPS indicates that it has a direct interest in the controversy because the proposed tower is near the Chickamauga and Chattanooga National Military Park. Counsel for NPS requests additional time due to extraordinary time constraints including an already scheduled trial during the week of July 9, 2007. Although the Commission does not routinely grant requests for extension of time, in this instance we find that a full opportunity to obtain the considered comments of all interested parties, including NPS, would serve the public interest. The Division therefore grants the NPS Motion and extends the time for filing Oppositions to WNP’s Application to July 20, 2007. Any interested party must file its Opposition to WNP’s Application by July 20, 2007.3 Replies to Oppositions are due July 30, 2007.
