Washington, D.C. 20554 News Media Information 202 / 418-0500 Internet: http://www.fcc.gov TTY: 1-888-835-5322 DA 07-3087 Released: July 10, 2007 LPTV AND TV TRANSLATOR APPLICATIONS NON-MUTUALLY EXCLUSIVE PROPOSALS Media Bureau Announces August 9, 2007 Long Form Application Deadline for Singleton Proposals On June 23, 2000, the Media Bureau and Wireless Telecommunications Bureau (Bureaus) announced a filing window for low power television (LPTV), TV translator, and Class A TV stations.1 Subsequently, the Bureaus released a Public Notice announcing those proposals that were mutually exclusive (MX) and providing a 60-day settlement period by which interested parties could submit settlements and/or engineering amendments to resolve their MX Groups.2 During the settlement period, the Bureaus received engineering amendments to proposals in the MX Groups. By this Public Notice, the Video Division of the Media Bureau provides Attachment A as a list of proposals that are no longer mutually exclusive as a result of engineering amendments filed during the settlement period. Since the proposals listed in Attachment A are no longer mutually exclusive with any other proposal (and are therefore deemed “singletons”), they will not be subject to the Commission’s auction procedures.3 By this Public Notice, the Video Division announces processing procedures for these singleton proposals. 1 The initial filing window for this group of short-form applications (FCC Forms 175) began on July 31 and ended on August 31, 2000. On February 13, 2001, the Video Services Division of the Mass Media Bureau released an initial public notice listing singleton engineering proposals submitted during the 2000 filing window. On September 14, 2005, bidding began in Auction No. 81 among 44 qualified applicants for 113 mutually-exclusive construction permits. Bidding in Auction No. 81 closed on September 26, 2005, with 39 winning bidders for 90 construction permits. The staff will dismiss, without further processing, the previously filed technical submissions of any applicant that fails to submit the complete FCC Form 346 by August 9, 2007.5 How to File: Applicants must file their long form applications electronically using FCC Form 346. Paper-filed applications will not be accepted. Instructions for use of the electronic filing system are available in the CDBS User’s Guide, which can be accessed from the electronic filing web site at: http://www.fcc.gov/mb/cdbs.html Applicants should select the “long form auction 81” option and enter the applicant’s appropriate short form application file number as specified on each applicant's short-form application. Inclusion on Attachment A of this Public Notice does not constitute acceptance of a proposal. The staff will review the submitted FCC Form 346 applications for acceptability. It will subsequently announce applications determined to be acceptable for filing and which the staff is prepared to grant. Petitions to deny these applications must be filed within 15 days following the release of the public notice announcing acceptance of the applications at issue.6 Interested parties should monitor these public notices.
