The Audio Division has before it a Petition for Reconsideration filed by Renaissance Community Improvement Association, Inc. (“Renaissance”) directed against the Report and Order in this proceeding.1 For the reasons discussed below, we dismiss the Petition for Reconsideration. 2. At the request of Renaissance, the Notice of Proposed Rule Making in this proceeding proposed the allotment of Channel 235A to Keno, Oregon, in order to permit Renaissance to amend its application for Channel 253A at Keno (File No. BPED-950206MB).2 This would allow Renaissance to resolve its mutual exclusivity with an application filed by Fatima Response, Inc. d/b/a St. Michael’s Catholic Radio (BPED-950206MH). On April 7, 2004, both applications were dismissed for failure to respond to official Commission correspondence.3 In view of the dismissal of those applications, there was no basis to go forward with this proceeding and the Report and Order dismissed the Renaissance Petition for Rule Making. 3. In its Petition for Reconsideration, Renaissance notes that both it and St. Michael’s Catholic Radio have filed a Petition for Reconsideration directed against the dismissal of their respective applications. In view of the fact that these Petitions for Reconsideration remain pending, Renaissance requests that we reconsider our dismissal of its Petition for Rule Making and permit this proceeding to remain open pending final action on the two applications. 4. We dismiss the Petition for Reconsideration filed by Renaissance in this proceeding. On April 30, 2007, after granting reconsideration with regard to application proceedings and of reinstating the Renaissance and St. Michael Catholic Radio applications, we again dismissed both applications for the 1 Keno, Oregon, Report and Order, 19 FCC Rcd 12802 (MB 2004). 2 Keno, Oregon, Notice of proposed Rule Making, 14 FCC Rcd 13907 (MMB 1999). 3 Letter to Fatima Response, Inc. and Renaissance Community Improvement Association, Inc., Ref.
