BLTTL-20030902AAQ; BESTA-20070515ADY; BMPTTL-20061024AFI; and BLTTL-20060607AAR Facility ID No. 61692 Dear Counsel: By letter dated July 20, 2007, the Video Division (“Division”) denied reconsideration of the staff’s May 8, 2006 letter decision dismissing the above-referenced application for a license to cover the displacement construction permit for low power television station W46EB, Arbury Hills, Illinois, authorized to Marcia Cohen (“Cohen”). WCIU-TV Limited Partnership, a subsidiary of Weigel Broadcasting Co. and the licensee of WCIU-TV, Chicago, Illinois (collectively, “WCIU”), had opposed grant of reconsideration. Cohen has been operating W46EB pursuant to Special Temporary Authorization (STA), but, finding that Cohen’s construction permit for channel 46 had expired as a matter of law on June 11, 2006, the Division denied her application for an extension of the STA. The Division specified July 27, 2007 as the effective date of the cancellation of the STA authority. Cohen filed a “Motion for Stay of Video Division Directive Pending Commission Review” (“Stay Request”) on July 24, 2007, asking that the Commission stay the effect of the Video Division’s directive that station W46EB terminate its current broadcast operations by July 27, 2007. We have also received a letter, dated today, from WCIU stating that it intends to file an opposition to the Stay Request. We believe the public interest would be served by allowing the parties to fully brief the Stay Request before requiring the termination of station operations. Accordingly, pursuant to Section 1.113(a) of the Commission’s rules, the Video Division HEREBY MODIFIES its July 20, 2007 letter decision and 2 directs Cohen to cease operations on channel 46 no later than September 27, 2007, and to remove the channel 46 antenna and transmission lines from the AON tower within 15 business days from the date of the termination of operations.
