On July 30, 2007, the National Cable & Telecommunications Association (“NCTA”) filed an application for review of the Media Bureau’s decision in the above-captioned proceeding.1 Section 1.115(d) of the Commission’s rules2 states that oppositions to applications for review are due 15 days after the filing of an application for review and that replies to oppositions are due 10 days after oppositions are filed, which would set deadlines of August 14, 2007 for oppositions to the application for review and August 24, 2007 for replies to those oppositions. 2. On July 30, 2007, the Consumer Electronics Association (“CEA”) and NCTA filed a joint motion seeking an extension of time to file oppositions and replies to oppositions, making the deadlines September 14, 2007 and October 9, 2007, respectively.3 CEA and NCTA state that interested parties 1 Application for Review of National Cable & Telecommunications Association (filed July 30, 2007). Federal Communications Commission DA 07-3516 2 need more time to respond to NCTA’s application for review of the Bureau’s order because the deadlines imposed by Section 1.115(d) of the Commission’s rules would interfere with the ability of interested parties to prepare comments in response to the Commission’s Third Further Notice of Proposed Rulemaking regarding the Implementation of Section 304 of the Telecommunications Act of 1996.4 3. Given that replies to oppositions to NCTA’s application for review are due the same day that comments are due in response to the Two-Way Plug-and-Play NPRM and the issues in these two proceedings are related, good cause exists to grant a limited extension of time. Therefore, we extend the deadline for filing oppositions to the application for review to September 14, 2007, and the deadline for filing replies to those oppositions to October 9, 2007. 4. Accordingly, IT IS ORDERED that, pursuant to Sections 4(i), 4(j) and 5(c) of the Communications Act of 1934, as amended, 47 U.S.C. §§ 154(i), 154(j) and 155(c), and Sections 0.61, 0.283, and 1.46 of the Commission’s rules, 47 C.F.R. §§ 0.61, 0.283, and 1.46, the date for filing oppositions to the application for review in CSR-7056-Z, which pertains to NCTA’s request for waiver of Section 76.1204(a)(1) of the Commission’s rules, 47 C.F.R. § 76.1204(a)(1), is extended to September 14, 2007, and the date for filing replies to oppositions to the application for review in CSR-7056-Z is extended to October 9, 2007.
