Washington, D.C. 20554 News Media Information 202 / 418-0500 Fax-On-Demand 202 / 418-2830 TTY 202 / 418-2555 Internet: http://www.fcc.gov ftp.fcc.gov DA 07-4262 Released: October 18, 2007 Media Bureau Implements Mandatory Electronic Filing of Broadcast EEO Mid-Term Report (FCC Form 397) By this Public Notice, the Media Bureau announces mandatory electronic filing for FCC Form 397, the Equal Employment Opportunity (“EEO”) form entitled “Broadcast Mid-Term Report.” Electronic filing became available on March 9, 2007, and became mandatory on September 9, 2007. A paper version of this Form will not be accepted for filing unless accompanied by an appropriate request for waiver of the electronic filing requirement. Users can access the electronic filing system via the Internet from the Media Bureau’s website at http://www.fcc.gov/mb/cdbs.html. To enable the Commission’s staff to conduct its mid-term review of the EEO practices of its broadcast licensees, the Commission’s EEO rules and policies, including Section 73.2080(f)(2) of those rules, require that, where a radio station is part of an employment unit with more than ten full-time employees or a television station is part of a unit with five or more full-time employees, its unit must file FCC Form 397. The Form seeks certain information about the stations that comprise the unit and identification of the person responsible for EEO matters, and requires the submission of the unit’s two most recent EEO public file reports. The Form must be filed four years after the due date of the unit station’s last license renewal application, which was four months prior to the station’s last license expiration date, as provided for in Section 73.1020 of the Rules. Thus, licensees of radio stations licensed in Alabama and Georgia must file by December 1, 2007. The first group that must file in 2008 consists of licensees of radio stations in Arkansas, Louisiana, and Mississippi, who must file Form 397 by February 1, 2008.
