Federal Communications Commission Washington, D.C. 20554 DA 07-4702 Released: November 21, 2007 Marcia Cohen c/o Aaron Shainis, Esq. Shainis & Peltzman, Chartered 1850 M Street, N.W. Suite 240 Washington, D.C. 20036 WCIU-TV Limited Partnership Weigel Broadcasting Co. c/o J. Brian DeBoice, Esq. Cohen & Marks, LLP Suite 300 Washington, D.C. Re: W46EB (formerly W46DM) Arbury Hills, Illinois File Nos. BLTTL-20030902AAQ; BESTA-20070515ADY; BMPTTL-20061024AFI; BLTTL-20060607AAR Facility ID No. 61692 Dear Counsel: By letter dated July 20, 2007, the Video Division denied reconsideration of the staff’s May 8, 2006 letter decision dismissing the above-referenced application for a license to cover the displacement construction permit for low power television station W46EB, Arbury Hills, Illinois, authorized to Marcia Cohen. Because Cohen’s construction permit for channel 46 had expired as a matter of law on June 11, 2006, the Division also denied her application for an extension of the STA, specifying July 27, 2007 as the effective date of the cancellation of the STA authority. Cohen filed a “Motion for Stay of Video Division Directive Pending Commission Review” on July 24, 2007, asking that the Commission stay the effect of the Video Division’s directive that station W46EB terminate its current broadcast operations by July 27, 2007. By letter dated July 26, 2007, the Division modified its letter action to direct Cohen to cease operating no later than September 27, 2007, concluding that the public interest would be served by allowing the parties to fully brief the stay request before requiring the termination of station operations. The stay request has now been fully briefed by Cohen and WCIU-TV Limited Partnership, the licensee of WCIU-TV, Chicago, and is under consideration. Accordingly, pursuant to Section 1.113(a) of the Commission’s rules, the Video Division HEREBY MODIFIES its July 20 and 26, 2007 letter actions to direct Cohen to cease operations on channel 26 no later than February 27, 2008, and to remove the channel 46 antenna and transmission lines from the AON tower within 15 business days from the date of the termination of operations. Sincerely, James J. Brown Deputy Chief, Video Division Media Bureau
