Harris, Wiltshire & Grannis, LLP 1200 18th Street, NW, Suite 1200 Washington, DC 20036-2560 RE: Petition for Reconsideration of Grant of Cancellation Requests; File Nos. 0003090688, 0003090693 Dear Mr. Nierman: This letter pertains to the petition (Petition)1 that you filed on July 26, 2007 on behalf of United States Surgical Corporation (Petitioner), seeking reconsideration of our grant of the Petitioner’s license cancellation requests for Stations WNXF583 and WNYXS365.2 Petitioner seeks reinstatement of the subject licenses because the cancellation requests were submitted in error due to internal miscommunication.3 We grant the Petition because the cancellation requests were filed in error.4 In addition, because no applications seeking authorization for co-channel in the vicinity of Stations WNXF583 and WNYX365 were received or granted since the licenses were canceled, this action will not negatively impact any prospective or current co-channel licensee. ACCORDINGLY, IT IS ORDERED that, pursuant to Sections 4(i) and 405 of the Communications Act of 1934, as amended, 47 U.S.C. §§ 154(i), 405, and Section 1.106 of the Commission’s Rules, 47 C.F.R. § 1.106, the Petition for Reconsideration filed by United States Surgical Corporation on July 26, 2007 is GRANTED, and the licenses for Stations WNXF583 and WNYS365 SHALL BE REINSTATED. This action is taken under delegated authority pursuant to Sections 0.131 and 0.331 of the Commission’s Rules, 47 C.F.R. §§ 0.131, 0.331.
