The Audio Division has before it: (1) a Notice of Proposed Rule Making1 issued at the request of Charles Crawford (“Petitioner”); and (2) supporting comments filed by the Petitioner. For the reasons discussed below, we will grant the rulemaking petition. 2. Background. In response to the Petitioner’s rulemaking petition, the NPRM proposed the allotment of Channel 236C1 at Hale Center, Texas (pop. 2,263) as a first local aural service. The Petitioner filed comments, supporting the NPRM’s proposal. The Petitioner also reiterated his intention to apply for Channel 236C1 at Hale Center and promptly to construct a facility after grant of the application. 3. Discussion. We will allot Channel 236C1 to Hale Center because it will serve the public interest by providing a first local service to that community.2 Hale Center is a community for allotment purposes. As described in the NPRM, Hale Center is an incorporated city and has its own mayor, city offices, fire department, 85 businesses, and a number of local churches. 4. Accordingly, pursuant to the authority contained in 47 U.S.C. Sections 4(i), 5(c)(1), 303(g) and (r), and 307(b), and 47 C.F.R. Sections 0.61, 0.204(b), and 0.283, IT IS ORDERED, That effective February 26, 2007, the FM Table of Allotments, 47 C.F.R. Section 73.202(b), IS AMENDED, with respect to the community listed below, as follows: Community Channel No. Hale Center, Texas 236C1 5. A filing window for Channel 236C1 at Hale Center, Texas, will not be opened at this time.
