You believe that the requested call sign was available as of the date of your application, and that the dismissal of your application therefore was in error. For the reasons discussed herein, we deny your request. Section 97.19(c)(1) of the Commission’s Rules provides, with certain exceptions not relevant in this case, that a call sign shown on an expired license is not available to the vanity call sign system for two years following the expiration of the license.1 This two-year period corresponds to the grace period during which the licensee of an amateur station may apply for renewal of the station and operator license. Only after the period has expired does the call sign become available for reassignment.2 The prior license for call sign K6BQ expired on February 22, 2004. Therefore, the two-year period terminated at the end of February 22, 2006, and the license was canceled on February 23, 2006. You filed the above-referenced application on February 22, 2006. At that time, the call sign was not yet available for reassignment, because the two-year period had not expired. Consequently, we conclude that your application was properly dismissed.3 Accordingly, IT IS ORDERED that, pursuant to Sections 4(i) and 405 of the Communications Act of 1934, as amended, 47 U.S.C. §§ 154(i), 405, and Section 1.106 of the Commission’s Rules, 47 C.F.R. § 1.106, the request to reconsider the dismissal of application File No. 0002494225 filed by Mr. Kenneth C.
