Moody 9600 30th Street Colfax, WI 54730 Re: File No. 0002557346 Dear Mr. Moody: This letter is in response to your request for reconsideration of the dismissal of the above- referenced application in which you requested assignment of the amateur station call sign K9RM to your amateur station. You apparently believe that the requested call sign was available as of the date of your application and that the dismissal of your application therefore was in error. For the reasons discussed herein, we deny your request. Vanity call signs are selected from those call signs assignable at the time the application is processed.1 A call sign is not available for reassignment until two years after the license expires or the licensee’s death, whichever is sooner.2 On April 3, 2006, the Commission received your application requesting that your amateur station license be modified to show the call sign K9RM.3 At that time, the Commission's Universal Licensing System (ULS) database indicated that call sign K9RM was not available for assignment because the license had expired less than two years earlier.4 Accordingly, your application was dismissed on April 21, 2006. On June 7, 2006, the Commission received notification that the licensee of amateur station K9RM had died on December 18, 2002. This information was entered into the ULS database on June 9, 2006.5 Because more that two years had passed since the licensee's death, amateur station call sign K9RM became available to the vanity call sign system on June 9, 2006.6 1 47 C.F.R. § 97.19(d)(3). 2 47 C.F.R. § 97.19(c)(1), (3). Consequently, we conclude that your application was properly dismissed. Accordingly, IT IS ORDERED that, pursuant to Sections 4(i) and 405 of the Communications Act of 1934, as amended, 47 U.S.C. §§ 154(i), 405, and Section 1.106 of the Commission’s Rules, 47 C.F.R. § 1.106, the request to reconsider the dismissal of application File No. 0002557346 filed on June 12, 2006 by Mr. Ronald W. Moody IS DENIED. This action is taken under delegated authority pursuant to Sections 0.131 and 0.331 of the Commission's Rules, 47 C.F.R. §§ 0.131 and 0.331.
