Washington, D.C. 20554 News Media Information 202 / 418-0500 Internet: http://www.fcc.gov TTY: 1-888-835-5322 DA 07-855 Released: February 26, 2007 WIRELESS TELECOMMUNICATIONS BUREAU MOBILITY DIVISION APPROVES DISMISSAL OF APPLICATION FOR REVIEW AND WITHDRAWAL OF APPLICATION FOR REVIEW File No. 0001777981 By this Public Notice, the Mobility Division (Division) of the Wireless Telecommunications Bureau (Bureau) approves the dismissal and withdrawal of applications for review of the Bureau’s Aloha Order,1 filed by Paxson Communications Corp. (Paxson)2 on March 21, 2005 (Paxson Application for Review), and jointly filed by the Association for Maximum Service Television, Inc. (MSTV) and Tucson Communications, LLC (Tucson), on March 30, 2005 (MSTV/Tucson Application for Review), respectively. On February 14, 2007, Paxson filed a request to dismiss the Paxson Application for Review and, on February 23, 2007, certified that it received no consideration for its request (Paxson Request). On February 22, 2007, MSTV/Tucson filed a request to withdraw the MSTV/Tucson Application for Review, and each certified that it received no consideration for the withdrawal (MSTV/Tucson Request). The Division has reviewed the Paxson Request and the MSTV/Tucson Request and finds that neither raises any substantial or material questions of fact, and that each complies with Section 1.935 of the Commission’s Rules.3 Accordingly, pursuant to Section 0.331 of the Commission’s rules,4 the Division hereby approves the dismissal of the Paxson Application for Review, and the withdrawal of the MSTV/Tucson Application for Review.
