The Audio Division has before it a Petition for Rule Making filed by Terry A. Cowan (“Petitioner”), proposing to allot Channel 226C3 at Prineville, Oregon. Petitioner has concurrently filed a FCC Form 301 application1 for Channel 226C3 at Prineville, and states that he has submitted the requisite filing fee pursuant to Revision of Procedures Governing Amendments to FM Table of Allotments and Changes of Community of License in the Radio Broadcast Services.2 Petitioner certifies in his application that, if the requested FM channel is allotted, he will participate in the auction for the channel. 2. We believe the proposal warrants consideration because the proposed allotment could provide a fourth local commercial FM service to the community of Prineville under Priority 4 of the FM Allotment priorities.3 A staff engineering analysis indicates that Channel 226C3 can be allotted to Prineville, consistent with the minimum distance separation requirements of the Commission’s rules, at coordinates 44-26-17 NL and 120-57-12 WL with a site restriction of 11.4 km (7.1 miles) north of city reference. 3. The Commission’s authority to institute rule making proceedings, showings required, cut-off procedures, and filing requirements are contained in the attached Appendix and are incorporated by reference herein. In particular, we note that a showing of continuing interest is required in paragraph 2 of the Appendix before a channel will be allotted. 5. Pursuant to Sections 1.415 and 1.419,6 interested parties may file comments on or before April 23, 2007 and reply comments on or before May 8, 2007, and are advised to read the Appendix for the proper procedures. Comments are invited on the proposal(s) discussed in the Notice of Proposed Rule Making to which this Appendix is attached. Proponent(s) will be expected to answer whatever questions are presented in initial comments. The proponent of a proposed allotment is also expected to file comments even if it only resubmits or incorporates by reference its former pleadings. It should also restate its present intention to apply for the channel if it is allotted and, if authorized, to build a station promptly. Failure to file may lead to denial of the request. 3. Cut-off protection. The following procedures will govern the consideration of filings in this proceeding: (a) Counterproposals advanced in this proceeding itself will be considered, if advanced in initial comments, so that parties may comment on them in reply comments.
