Federal Communications Commission DA 08-1151 Before the Federal Communications Commission Washington, D.C. 20554 In the Matter of: WUPW Broadcasting, LLC, licensee of WUPW, Toledo, Ohio Petition for Waiver of Sections 76.92(f) and 76.106(a) of the Commission’s Rules ) ) ) ) ) ) ) CSR-7853-N ORDER Adopted: May 14, 2008 Released: May 14, 2008 By the Senior Deputy Chief, Policy Division, Media Bureau: 1. On May 12, 2008, WUPW Broadcasting, LLC (“WUPW”) filed a Motion for Extension of Time (“Motion”) requesting an additional two weeks, until May 28, 2008, to submit a reply to the Opposition of Buckeye Cablevision, Inc. (“Buckeye”) to WUPW’s Petition for Special Relief (“Petition”) in the above-captioned matter. In support of its Motion, WUPW asserts that Buckeye’s 126-page Opposition, which was sent to WUPW via U.S. mail on May 1, 2008, raises multiple objections to the standard survey methodology used by The Nielsen Company for petitions of this nature, and thus necessitates additional time for WUPW to prepare a response.1 Buckeye urges the Bureau to deny WUPW’s Motion on the basis that it fails to demonstrate extraordinary circumstances, and because the time requested is unduly lengthy given WUPW’s advance notice of Buckeye’s objections.2 2. We grant WUPW an extension of time to respond to Buckeye’s Opposition. However, we agree with Buckeye that WUPW’s requested extension is excessive and will require that WUPW’s reply be filed no later than May 23, 2008. We find that permitting WUPW this additional time will allow it to obtain the information needed to prepare an adequate response, and will enable the Bureau to address the merits of WUPW’s Petition on the basis of a more complete record. 1 In the Matter of WUPW Broadcasting, LLC, licensee of WUPW, Toledo, Ohio, Petition for Waiver of Sections 76.92(f) and 76.106(a) of the Commission’s Rules, Motion for Extension of Time to File Reply to Opposition to Petition for Special Relief, filed on behalf of WUPW Broadcasting, LLC, May 12, 2008. 2 In the Matter of WUPW Broadcasting, LLC, licensee of WUPW, Toledo, Ohio, Petition for Waiver of Sections 76.92(f) and 76.106(a) of the Commission’s Rules, Opposition to Motion for Extension of Time, filed on behalf of Buckeye Cablevision, Inc., May 13, 2008.
