Federal Communications Commission Washington, D.C. 20554 January 23, 2008 DA 08-149 Mr. John Arndt 1008 North 64th Street Philadelphia, Pennsylvania 19151 Re: Radio One Licenses, LLC Dear Mr. Arndt: This is in response to your January 31, 2006, complaint, in which you alleged that numerous websites of broadcast stations licensed to Radio One Licenses, LLC (“Radio One”), contained links to Equal Employment Opportunity (“EEO”) public file reports that were outdated.1 Radio One owns and/or operates 70 broadcast stations located in 22 markets in the United States. You reported in your complaint that the EEO public file reports accessible on the Radio One station websites were not current: none was for a year later than 2004. The Commission’s rules require at 47 C.F.R. § 73.2080(c)(6) that each broadcast station place its EEO public file report annually in the station’s public file, and on its website if it has one, on the anniversary of the date the station is due to file its renewal application. The Commission’s initial investigation of your complaint revealed that the Radio One station websites each contained a common link to EEO reports which took the user to the Radio One corporate site. Although the links all worked, as you noted in the complaint, none of the posted reports on that central corporate site was for 2005. However, Radio One updated its individual station websites sometime after the Commission’s initial investigation and placed its individual 2005 public file reports for each station on its website.2 Radio One has since posted the 2006 and 2007 reports on each station website. Notwithstanding Radio One’s subsequent elimination of these deficiencies, we do not excuse its previous failure to have properly posted its current reports. Although this is not a violation of our rules because the individual station websites are up-to-date, to avoid confusion we urge Radio One to either replace the out-of-date reports from its corporate website with current ones, or provide links on that site to the sites of its stations containing the current reports. While we cannot excuse Radio One’s failure during 2005 to have posted its current reports for its broadcast stations, under the circumstances, we exercise our prosecutorial discretion and decline to take further action in this matter. Accordingly, your complaint is hereby dismissed. We appreciate your bringing this matter to our attention.
