Federal Communications Commission DA 08-1650 Before the Federal Communications Commission Washington, D.C. 20554 In the Matter of: TCR Sports Broadcasting Holding, L.L.P., d/b/a Mid-Atlantic Sports Network v. Time Warner Cable Inc. Petition for Review ) ) ) ) ) ) ) ) ) ) ORDER Adopted: July 11, 2008 Released: July 11, 2008 By the Deputy Chief, Policy Division, Media Bureau: 1. On July 11, 2008, TCR Sports Broadcasting Holding, L.L.P., d/b/a Mid-Atlantic Sports Network (“MASN”) filed a Motion for Extension of Time to File Opposition (“Motion”) requesting an additional three days, until July 17, 2008, to submit an opposition to the Petition for Review (“Petition”) filed by Time Warner Cable Inc. (“Time Warner”) in the above-captioned matter. MASN asserts that, given the unique nature of the Commission’s arbitration remedy in the Adelphia Order1, MASN had concluded that the timing for its opposition should be governed by Section 1.115(d) of the Commission’s rules, which would give MASN fifteen days to file an opposition to Time Warner’s Petition, and that MASN had attempted to contact Bureau staff in an effort to confirm its understanding.2 MASN states that, on July 11, 2008, Bureau staff informed it that, pursuant to Section 1.45 of the Commission’s rules, the deadline for filing MASN’s opposition was, in fact, July 14, 2008.3 Among other things, MASN asserts that, given the length and complexity of Time Warner’s Petition, and the importance of issues raised in the proceeding, a three-day extension of time to file an opposition is warranted.4 2. We grant MASN an extension of time to respond to Time Warner’s Petition for Review.5 We find that permitting MASN this additional time will allow it to prepare an adequate response and 1 Applications for Consent to the Assignment and/or Transfer of Control of Licenses, Adelphia Communications Corporation, Assignors to Time Warner Cable, Inc., et al., Memorandum Opinion and Order, MB Docket No. 05- 192, 21 FCC Rcd 8203 (2006). 2 In the Matter of TCR Sports Broadcasting Holding, L.L.P., d/b/a Mid-Atlantic Sports Network v.
