The Commission has before it a Notice of Proposed Rulemaking1 issued in response to a petition for rulemaking filed by the Georgia Public Telecommunications Commission (“GPTC”), the permittee of noncommercial educational station WJSP-DT, DTV channel *23, Columbus, Georgia, requesting the substitution of DTV channel *11 for channel *23 at Columbus. 2. On September 5, 2008, GPTC and WTVM License Subsidiary, LLC (“WTVM”), the permittee of WTVM-DT, Columbus, Georgia, filed a Joint Request for Approval of Request to Dismiss Petition for Rulemaking. The Joint Request states that GPTC and WTVM have filed mutually-exclusive rulemaking petitions and that GPTC has agreed to the dismissal of its channel substitution request in exchange for WTVM reimbursing GPTC for its out-of-pocket expenses. 3. We believe, for the reasons set forth in the Joint Request for Approval, that the public interest would be served by approving the Joint Request and dismissing GPTC’s rulemaking petition. 4. Accordingly, IT IS ORDERED that the Petition for Rulemaking to Substitute DTV Channel for Columbus, Georgia filed by Georgia Public Telecommunications Commission IS HEREBY DISMISSED. 5.
