Washington, D.C. 20004-2401 Re: MB Docket No. 05-317 Dear Licensee: By letter dated August 7, 2008, and supplemented on October 21, 2008, KHNL/KFVE Licensee Subsidiary, LLC, a subsidiary of Raycom Media, Inc. (“Raycom”) and the permittee of KOGG-DT, Wailuku, Hawaii, requested renewal of its waiver of Section 339(a)(2)(D) of the Communications Act of 1934, as amended, to prohibit satellite subscribers from receiving or conducting a digital signal strength test of KOGG-DT’s digital signal.1 The Commission granted the original digital signal testing waiver based on the unremediable presence of “clear zoning or environmental legal impediments,”2 and has granted three six-month extensions.3 In its supplement, Raycom states that it has now received the approval of the U.S. Fish and Wildlife Service for the use of the station’s authorized transmitter site at Ulupalakua Ranch, and that it will be able to complete construction of its digital facility no later than February 17, 2009. Raycom also states that it presently intends to participate in the Hawaii Association of Broadcasters early transition plan, under which the state’s full-power broadcasters will transition to final digital operations and end analog operation on January 15, 2009, rather than February 17, 2009. Accordingly, IT IS ORDERED that the request of Raycom IS GRANTED and the first permissible date for digital testing for KOGG-DT IS EXTENDED from October 31, 2008 to January 15, 2009.
