Fees for Ancillary and Supplementary Services 
Effective Today Permittees As Well As Licensees Must Comply with 47 C.F.R. § 73.624(g)
Revised FCC Form 317 now available; deadline for filing is December 1, 2008
On December 31, 2007, the Commission released a Report and Order in the Third DTV Periodic Review 
of the nation’s transition to digital television (“DTV”).1 Among other things, the Third DTV Periodic 
Report and Order revised Section 73.624(g) of the Commission’s rules, which requires all commercial 
and non-commercial DTV stations to report annually, using FCC Form 317, whether they have provided 
ancillary and supplementary services and, if so, to pay a fee of five percent of gross revenues derived 
from certain of those services.  The Third DTV Periodic Report and Order revised Section 73.624(g) to 
make that section, formerly applicable only to DTV licensees, applicable also to permittees operating 
pursuant to an STA or any other FCC instrument authorizing DTV transmissions that earn revenue from 
feeable ancillary and supplementary services.2 The Commission also revised FCC Form 317 to include 
DTV permittees.
The changes made to Section 73.624(g) and to FCC Form 317 required approval by the Office of 
Management and Budget (“OMB”) prior to becoming effective.  We hereby notify broadcasters that 
OMB has now approved these changes,3 and notification of this approval was published today in the 
Federal Register.4 Accordingly, the revisions to Section 73.624(g) adopted in the Third DTV Periodic 
Review Report and Order and the changes to FCC Form 317 are now effective.  
The revised FCC Form 317 is now available on the FCC’s website (www.fcc.gov).  All DTV licensees 
and permittees must file FCC Form 317 no later than December 1, 2008.
