Gordon, IV McLean Bible Church 8925 Leesburg Pike Vienna, VA 22182 Re: Call Sign E080013 File No. SES-LIC-20080115-00051 Dear Mr. Gordon: On January 15, 2008, McLean Bible Church filed the above-captioned application seeking authority to operate a new transmit and receive earth station that will operate in the Conventional Ku-band.1 Pursuant to Section 25.112(a)(1) of the Commission’s rules, 47 C.F.R. § 25.112(a)(1), we dismiss the application as defective without prejudice to refiling.2 Section 25.112 of the Commission’s rules, 47 C.F.R. § 25.112, requires the Commission to return, as unacceptable for filing, any earth station application that is not substantially complete, contains internal inconsistencies, or does not substantially comply with the Commission’s rules. McLean Bible Church’s application contains internal inconsistencies with respect to emission power, which renders it unacceptable and subject to dismissal. The deficiency is as follows: In response to item E49 of Schedule B, McLean Bible Church lists a maximum equivalent isotropic radiated power (e.i.r.p.) density per carrier for emission designator 9M00H1F of the transmit frequency as 35.46 dBW/4kHz. This value is less than, and therefore inconsistent with, the average value of 42.29 dBW/4kHz that we calculate using the e.i.r.p. value of 75.81 dBW McLean Bible Church provides in response to item E48 and the 9 megahertz bandwidth of the corresponding H1F emission McLean Bible Church provides in response to item E47 of Schedule B.
