No: 200732400004 FRN: 0016 9778 45 FORFEITURE ORDER Adopted: March 6, 2008 Released: March 10, 2008 By the Acting Regional Director, Northeast Region, Enforcement Bureau: 1. In this Forfeiture Order (“Order”), we issue a monetary forfeiture in the amount of ten thousand dollars ($10,000) to Michael Stone Campbell, a/k/a Monroe Campbell, for willfully and repeatedly violating Section 301 of the Communications Act of 1934, as amended (“Act”),1 by operating an unlicensed radio transmitter on the frequency 97.7 MHz in Philadelphia, PA. 2. On October 2, 2007, the Commission’s Philadelphia Field Office issued a Notice of Apparent Liability for Forfeiture (“NAL”) in the amount of $10,000 to Campbell.2 Although Campbell has not filed a response to the NAL, Campbell submitted a letter to Senator Arlen Specter, which was forwarded to the Commission on December 26, 2007.3 3. In his letter to Senator Specter, Campbell states that he began providing live broadcasts in Philadelphia on 97.7 MHz in December 1994. Campbell claims that the FCC lost his construction permit application, but Campbell never has provided any evidence that he submitted such an application. Moreover, even if Campbell had provided such evidence, the mere filing of an application would not have provided Campbell any authority to operate a radio station. Accordingly, based on the information before us, we affirm the forfeiture. 4. ACCORDINGLY, IT IS ORDERED that, pursuant to Section 503(b) of the Communications Act of 1934, as amended (“Act”),4 and Sections 0.111, 0.311 and 1.80(f)(4) of the 1 47 U.S.C. § 301. 2 Notice of Apparent Liability for Forfeiture, NAL/Acct.
