COMMENT AND REPLY COMMENT DATES
FOR THE FURTHER NOTICE OF PROPOSED RULEMAKING REGARDING 
EXCLUSIVE SERVICE CONTRACTS FOR PROVISION OF VIDEO SERVICES IN 
MULTIPLE DWELLING UNITS AND OTHER REAL ESTATE DEVELOPMENTS

On November 13, 2007, the Commission released a Further Notice of Proposed Rulemaking
(“FNPRM”) concerning exclusive service contracts for the provision of video services in multiple 
dwelling units (“MDUs”) and other centrally managed residential real estate developments.  The FNPRM
raised issues concerning exclusivity clauses in service contracts executed by providers of Direct 
Broadcast Satellite service, Private Cable Operators, and other multichannel video programming 
distributors that are not subject to Section 628 of the Communications Act of 1934, as amended.1 The 
FNPRM also asked about so-called marketing exclusivity provisions and “bulk billing” arrangements in 
MDUs.2 The FNPRM set deadlines for filing comments and reply comments at 30 and 60 days, 
respectively, after publication in the Federal Register.3
On January 7, 2008, the FNPRM was published in the Federal Register.4 Accordingly, comments 
must be filed on or before February 6, 2008, and reply comments must be filed on or before March 7, 
2008.  Commenters should follow the filing instructions provided in paragraphs 67 through 69 of the 
FNPRM.5 The FNPRM is also available on the Commission’s website.6
