The Audio Division has before it a petition for rule making filed by Maupin Broadcasting Company (“Petitioner”), proposing the allotment of Channel 244C2 at Maupin, Oregon.1 In compliance with the Commission's new procedures,2 Petitioner has concurrently filed an FCC Form 301 application for Channel 244C2 at Maupin, and the necessary filing fees.3 2. Petitioner proposes the allotment of Channel 244C2 at Maupin, Oregon, as its first local transmission service. In this regard, Petitioner states that Maupin was incorporated in 1922, and has a 2000 U.S. Census population of 411 persons. A staff engineering analysis indicates that Channel 244C2 can be allotted to Maupin consistent with the minimum distance separation requirements of the Rules with a site restriction 1.2 kilometers (0.7 miles) west located at reference coordinates 45-10-24 NL and 121-05-43 WL. 3. The Petitioner’s proposal warrants consideration because it could provide a first local service to the community of Maupin. Therefore, we will solicit comments on the proposed amendment to the FM Table of Allotments, Section 73.202(b) of the Rules, with respect to Maupin, Oregon: 1 The Petitioner filed a Petition for Reconsideration of the staff letter decision, returning its proposal for noncompliance with Section 73.207 of the Rules because the proposed Channel 244C2 at Maupin is short-spaced to the licensed site of Station KWLZ-FM, Channel 243C, Warm Springs, Oregon. We hereby grant the Petition for Reconsideration because Station KWLZ- FM’s authorization has been modified to specified operation on Channel 242C3 at West Linn, Oregon pursuant to our new community of license procedures. See Revision of Procedures Governing Amendments to FM Table of Allotments and Changes of Community of License in the Radio Broadcast Services, Report and Order, 21 FCC Rcd 14212 (2006). As such, Station KWLZ-FM has an outstanding construction permit on Channel 242C3 at West Linn. See File No. BPH-20070119AAT. Additionally, Station KWLZ-FM has a pending application, requesting to modify its facilities at West Linn, Oregon. The Commission’s authority to institute rule making proceedings, showings required, cut-off procedures, and filing requirements are contained in the attached Appendix and are incorporated by reference herein. In particular, we note that a showing of continuing interest is required by paragraph 2 of the Appendix before a channel will be allotted. 5. Interested parties may file comments on or before September 24, 2009, and reply comments on or before October 9, 2009, and are advised to read the Appendix for the proper procedures. Showings Required. Comments are invited on the proposal(s) discussed in the Notice of Proposed Rule Making to which this Appendix is attached. Proponent(s) will be expected to answer whatever questions are presented in initial comments. The proponent of a proposed allotment is also expected to file comments even if it only resubmits or incorporates by reference its former pleadings. It should also restate its present intention to apply for the channel if it is allotted and, if authorized, to build a station promptly. Failure to file may lead to denial of the request. 3. Cut-off protection. The following procedures will govern the consideration of filings in this proceeding. (a) Counterproposals advanced in this proceeding itself will be considered, if advanced in initial comments, so that parties may comment on them in reply comments. They will not be considered if advanced in reply comments. (See Section 1.420(d) of the Commission's Rules). (b) With respect to petitions for rule making which conflict with the proposals in this Notice, they will be considered as comments in the proceeding, and Public Notice to this effect will be given as long as they are filed before the date for filing initial comments herein. If they are filed later than that, they will not be considered in connection with the decision in this docket. (c) The filing of a counterproposal may lead the Commission to allot a different channel than was requested for any of the communities involved. 4. Comments and Reply Comments; Service.
