Washington, D.C. 20554 News Media Information 202 / 418-0500 Internet: http://www.fcc.gov TTY: 1-888-835-5322 DA 09-1852 August 24, 2009 NOTICE OF EFFECTIVE DATE OF NEW FORBEARANCE PROCEDURAL RULES WC Docket No. 07-267 On June 26, 2009, the Commission adopted the Forbearance Procedures Order, which promulgated rules for the consideration of forbearance petitions under section 10 of the Communications Act of 1934, as amended.1 Those rules, except for new rule 1.54 (“Petitions for forbearance must be complete as filed”), which requires approval by the Office of Management and Budget, become effective 30 days after publication of notice of the order in the Federal Register.2 The Federal Register published a summary of the Forbearance Procedures Order on August 6, 2009.3 Accordingly, the following rules4 adopted in the Forbearance Procedures Order will take effect on September 8, 2009: § 1.55 Public notice of petitions for forbearance. § 1.56 Motions for summary denial of petitions for forbearance. § 1.57 Circulation and voting of petitions for forbearance. § 1.58 Forbearance petition quiet period prohibition. § 1.59 Withdrawal or narrowing of petitions for forbearance. As noted, the Forbearance Procedures Order also contains a new rule that specifies filing requirements for forbearance petitions.5 The rule contains new information collection requirements that are subject to the Paperwork Reduction Act of 1995 (PRA), Public Law No. 104-13.
