Washington, D.C. 20554 News Media Information 202 / 418-0500 Internet: http://www.fcc.gov TTY: 1-888-835-5322 DA 09-2214 Released: October 13, 2009 Media Bureau Establishes October 27, 2009, Initial Filing Date for Acceptance of Certain Noncommercial Educational FM Station Minor Change Applications The Media Bureau (“Bureau”) hereby announces that as of October 27, 2009, a noncommercial educational (“NCE”) FM applicant will not be required to demonstrate compliance with Section 73.525 of the Commission’s Rules,1 with regard to an “affected” TV Channel 6 station2 which has ceased analog transmissions and which has a new DTV channel assignment. In accordance with prior guidance provided by the Bureau,3 an NCE FM application filed prior to October 27, 2009, which fails to either (1) satisfy Section 73.525 protection requirements or (2) include an unconditional consent letter from the “affected” TV Channel 6 station, will be dismissed. NCE-FM applications must continue to provide protection to “affected” digital TV Channel 6 stations. Such applications will be processed on a case-by- case basis.
