In your request, you state that the District will be holding radio-check disaster preparedness drills on December 1, 2009, and January 5, February 2, March 2, May 4, and June 1, 2010 from 9:30 a.m. to 10:00 a.m. You state that these exercises will test radio equipment readiness, school-operator familiarity with the equipment, and operator familiarity with message relays for back-up communications in the event of an earthquake or other disaster. The drills will be held at various locations on the Palos Verdes Peninsula, California. You state that each school will transmit for about thirty seconds. Section 97.113(a)(3) of the Commission’s Rules, 47 C.F.R. § 97.113(a)(3), prohibits amateur licensees from transmitting communications in which they have a pecuniary interest, including communications on behalf of an employer. Section 1.3 of the Commission’s Rules, 47 C.F.R. § 1.3, provides that the Commission may waive its rules if good cause for waiver is shown. We conclude that grant of the waiver request is appropriate under the circumstances presented. The public interest in facilitating the December 1, January 5, February 2, March 2, May 4, and June 1 public safety exercises by permitting the specified amateur licensees to participate warrants this limited waiver of Section 97.113(a)(3). Iizuka Page 2 permits transmission of communications by the above-listed amateur employees on behalf of their employers during the December 1, 2009, and January 5, February 2, March 2, May 4, and June 1, 2010, exercises. Accordingly, IT IS ORDERED that the waiver request of the Palos Verdes Peninsula Unified School District, dated November 6, 2009, IS GRANTED.
