Washington, D.C. 20036 Re: MB Docket No. 05-317 Dear Mr. Davidson: By letters dated October 10, 2008, Hoak Media of Wichita Falls Licensee, LLC (“Hoak”), licensee of KAUZ-TV, Wichita Falls, Texas and WTVG, Inc., licensee of WTVG-TV, Toledo, Ohio requested extensions of waivers of Section 339(a)(2)(D) of the Communications Act of 1934, as amended, to prohibit satellite subscribers from receiving or conducting a digital signal strength test of the stations’ digital signals.1 The Commission originally granted each station a digital signal testing waiver based on the fact that the stations’ digital signal coverage was limited due to the necessity to use a side mounted antenna.2 The Commission has granted each licensee two six-month extensions.3 In the most recent extension requests, the licensees state that each continues to experience reduction of coverage due to use of a side mounted antenna and that both stations are prevented from installing a top mounted digital antenna because their analog antennas are currently installed in that position and will continue to operate there until the digital transition takes place. On December 15, 2008, the Video Division of the Media Bureau granted each station an extension of its waiver until February 18, 2009, to coincide with the date on which stations were to complete the transition to digital broadcasting.4 Because that date has now been extended until June 12, 2009,5 we extend these waivers until June 13, 2009. Accordingly, IT IS ORDERED that the first permissible date for digital testing of KAUZ-DT and WTVG-DT IS EXTENDED until June 13, 2009. No further extensions of these waivers should be necessary.
