PUBLIC NOTICE Federal Communications Commission 445 12th St., S.W. Washington, D.C. 20554 News Media Information 202 / 418-0500 Internet: http://www.fcc.gov TTY: 1-888-835-5322 DA 09-2534 December 4, 2009 NOTICE CONCERNING EX PARTE STATUS OF INFORMATION SUBMITTED TO THE COMMUNICATIONS SECURITY, RELIABILITY AND INTEROPERABILITY COUNCIL Washington, DC – The Federal Communications Commission (“FCC” or “Commission”) recently announced the first meeting of the Communications Security, Reliability and Interoperability Council (CSRIC) to be held on Monday, December 7, 2009.1 The CSRIC is a federal advisory committee that will provide recommendations to the Commission regarding best practices and actions the Commission may take to ensure optimal operability, security, reliability, and resiliency of communications systems, including telecommunications, media and public safety communications systems. Under the Federal Advisory Committee Act, the Commission is responsible for oversight of the CSRIC, including its informal working groups.2 As a result, FCC staff may participate in meetings or other activities held by both the CSRIC and its informal working groups. In light of this, we are announcing that, pursuant to section 1.1200(a) of the Commission’s rules, 47 C.F.R. § 1.1200(a), presentations to the CSRIC will be treated as exempt presentations for ex parte purposes. This treatment is appropriate since presentations to the Council, like comments on a Notice of Inquiry, will not directly result in the promulgation of new rules. See 47 C.F.R. § 1.1204(b)(1) (exempt treatment of Notices of Inquiry). We recognize, however, that there are a number of presently pending dockets which are considering several issues that may be addressed by the Council.3 The Commission will not rely in these dockets on any information submitted to the Council, or to any of its subcommittees or working groups, unless that information is first placed in the record of the relevant rulemaking proceeding. Additional information regarding the CSRIC can be found at www.fcc.gov/pshs/advisory/csric/. 1 FCC Announces First Meeting of the Communications Security, Reliability and Interoperability Council (CSRIC) Scheduled For December 7, 2009 at FCC Headquarter, Public Notice, DA 09-2429 (PSHSB, November 17, 2009).
