The Commission has before it a Notice of Proposed Rulemaking1 issued in response to a petition for rulemaking filed by Comcorp of Texas License Corp. (“Comcorp”), the licensee of KWKT(TV), analog channel 44, and KWKT-DT, pre-transition DTV channel 57, and the permittee of post- transition DTV channel 44, Waco, Texas, requesting the substitution of DTV channel 25 for post-transition DTV channel 44 at Waco. 2. On January 26, 2009, Comcorp filed reply comments withdrawing its expression of interest in the channel substitution and requesting the withdrawal of its rulemaking petition. According to Comcorp, due to financial considerations, “it cannot justify the capital expenditure necessary to move KWKT-DT from DTV channel 44 to DTV channel 25.”2 3. Accordingly, IT IS ORDERED that the Petition for Rulemaking filed by Comcorp of Texas License Corp. IS HEREBY DISMISSED. 4. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED.
