Our April 23, 2008 letter directed CruiseEmail, pursuant to Section 308(b) of the Communications Act of 1934, as amended, 47 U.S.C. § 308(b), to provide information regarding the stations’ construction and operational status. According to your response, all three stations were timely constructed and have been in continuous operation since then, except for brief weather-related outages. Your response also indicates, however, that each station is currently operating at a site other than its licensed location. Your response also states that CruiseEmail’s mailing address is that set forth above, rather than the addresses on its licenses. (We also note that the copy of our letter mailed to the address listed for Station WGM was returned as undeliverable.) Each licensee is responsible for ensuring that its license information is kept current. Therefore, CruiseEmail must file applications seeking to modify its licenses to request authorization to operate at the actual locations. CruiseEmail also should modify the licenses to reflect its current contact information. In addition, this matter will be referred to the Commission’s Enforcement Bureau for investigation and consideration of applicable sanctions relating to operation at unlicensed locations.
