Federal Communications Commission Washington, D.C. 20554 April 2, 2009 DA 09-756 In Reply Refer to: 1800B3-BSH Released: April 2, 2009 Ms. Yesenia Orellana 106 South Jefferson Avenue, Suite 103 Mount Pleasant, Texas 75455 In re: DKLNA-LP, Pittsburg, Texas Facility ID No. 135706 File No. BLL-20080605AAF Petition for Reconsideration Dear Ms. Orellana: We have before us the Petition for Reconsideration filed November 7, 2008, by Yesenia Orellana (formerly Yesenia Herrador) (“Orellana”), Board member of Ministerios Tocando Corazones (“MTC”), licensee of now-cancelled Low Power FM Station DKLNA-LP (the “Station”), Pittsburg, Texas. Orellana requests reconsideration of the October 9, 2008, cancellation of the KLNA-LP license.1 For the reasons stated below, we deny Orellana’s Petition for Reconsideration. Background. By letter to the Commission dated August 25, 2008, Cenia Carillo (“Carillo”) requested cancellation of the KLNA-LP license. Carillo, also a Board member of MTC, was passed on by the Commission when it granted an assignment of license of KLNA-LP from Comunidad Cristiana of Pittsburg to MTC on July 11, 2006.2 In response, the staff cancelled the KLNA-LP license on October 9, 2008. Discussion. According to Commission ownership records, Carillo is a bona fide member of the MTC Board. Orellana asserts, however, that Carillo acted without the knowledge or consent of Orellana or the other MTC Board member. Orellana also states that Carillo, her former mother-in-law, acted for personal reasons in requesting the cancellation. We note that Orellana has failed to provide documentation demonstrating that Carillo lacks authority to act individually on behalf of the licensee. Moreover, the Commission has consistently held that it is not the proper forum for the resolution of private disputes such as this, and that the parties should seek redress for such matters in local courts of competent jurisdiction.3 Absent a court order establishing that Carillo was not authorized to act on behalf of MTC, we decline to grant Orellana’s Petition for Reconsideration. 1 Public Notice of the cancellation of the station’s license was issued on October 15, 2008. See Broadcast Actions, Public Notice, Report No. 46842 (MB Oct. 15, 2008). 2 See BALL-20060224AAI. 3 See John F. Runner, Receiver (KBIF), Memorandum Opinion and Order, 36 RR 2d 773, 778 (1976); Decatur Telecasting, Inc., Memorandum Opinion and Order, 7 FCC Rcd 8622 (1992). 2 Conclusion. Based on our review of the record and for the reasons set forth above, Yesenia Orellana’s November 7, 2008, Petition for Reconsideration IS DENIED. Sincerely, Peter H. Doyle Chief, Audio Division Media Bureau
