Having considered the United States’s Ex Parte Consent Application for an Order
Extending the Partial Unsealing of This Civil Action and the Memorandum in Support Thereof, ,
and the Court being informed in the matter, it is hereby
ORDERED that the United States’s Ex Parte Consent Application for an Order Extending
the Partial Unsealing of This Civil Action is GRANTED; and it is
FURTHER ORDERED that First Amended Complaint in this action is partially unsealed
to allow the United States, acting through the Federal Communications Commission, to disclose
and refer publicly to the allegations of the First Amended Complaint (redacted to maintain the
seal over the identity of the relator) in connection with the FCC’s administrative consideration of
applications for licenses by defendants and defendants’ related entities which are currently
pending before the FCC, and it is
FURTHER ORDERED that the United States may publicly disclose a copy of this Order
(redacted to maintain the seal over the identity of the relator); and it is
FURTHER ORDERED that all other filings in this case shall remain under seal until
further order of this Court; and it is
FURTHER ORDERED that the United States shall continue to have to and including
February 9, 2009, within which to intervene in this civil action or to notify the Court that it
declines to do so,
